Read these before booking. By submitting a quote request or making payment you confirm you have read and agree to these terms. If anything is unclear, email us before booking.
1 - Definitions
1.1"We", "us", "our" refers to evy.rentals, a trading name of evy.agency, sole trader, Plymouth, Devon.
1.2"You", "hirer" refers to the individual or company named on the booking and invoice.
1.3"Equipment" refers to any item or items hired under a confirmed booking, as listed on the invoice.
1.4"Hire period" means the dates confirmed at the time of booking, from the point of collection or delivery to the point of return.
2 - Booking & payment
2.1All bookings are subject to equipment availability and are confirmed only on receipt of full payment in cleared funds.
2.2Payment is by bank transfer against invoice. Kit will not be released until payment has cleared.
2.3Provisional holds may be made by email but do not constitute a confirmed booking and do not reserve equipment.
2.4Submitting a quote request form is not a booking or a commitment on either side. We will confirm availability and issue an invoice; the booking is confirmed when that invoice is paid.
2.5All prices are exclusive of VAT at the current rate (20%). VAT will be added to invoices where applicable.
3 - Insurance
3.1You are solely responsible for insuring all hired equipment against loss, theft, and accidental damage for its full replacement value for the entire hire period, including any transit.
3.2Equipment must remain the property of evy.rentals at all times. You may not sub-hire, pledge, or part with possession of any equipment to any third party.
3.3We may request written evidence of adequate insurance cover prior to releasing equipment. Failure to provide this when requested entitles us to refuse release.
3.4Hiring equipment without adequate insurance does not limit your liability under clause 5. The absence of insurance is your risk, not ours.
3.5Short-term production equipment cover is available from specialist insurers including Performance Insurance and Hencilla Canworth. This is for information only - we have no commercial relationship with either.
4 - Collection, delivery & return
4.1Equipment is available for collection from Plymouth by prior appointment. The collection address will be confirmed when the booking is paid.
4.2Delivery is available within a 25-mile radius of Plymouth at no additional charge, subject to prior arrangement. Delivery beyond 25 miles may be available at an additional cost - contact us to discuss.
4.3Risk in the equipment passes to you at the moment of collection or delivery and returns to us only when equipment has been received back and checked by us.
4.4You are responsible for checking all equipment at the point of collection. Any pre-existing damage or missing items must be raised at that point. Items not raised at collection will be assumed to have been damaged or lost during the hire period.
4.5Equipment must be returned in the same condition and with the same accessories, cases, and media as at the point of collection.
5 - Damage, loss & liability
5.1You are liable for the full replacement cost of any item that is lost, stolen, destroyed, or damaged beyond fair wear and tear during the hire period.
5.2Any damage or loss must be reported to us as soon as reasonably practicable and in any event before the end of the hire period.
5.3You may not attempt to repair or modify any equipment without our prior written consent.
5.4We accept no liability for any loss, damage, cost, or expense arising directly or indirectly from the failure, malfunction, or unavailability of equipment during the hire period.
5.5You are responsible for ensuring that all persons operating hired equipment are competent to do so and hold any required licences or permissions (including, where applicable, CAA permissions for drone operation).
6 - Hire period & late returns
6.1The hire period is as agreed and stated on the invoice.
6.2Equipment must be returned by the agreed time on the final day of the hire period.
6.3Late returns will be charged at the applicable day rate for each additional day or part day beyond the agreed return time.
6.4If you need to extend a hire, contact us as early as possible. Extensions are subject to availability and require payment before the original return time.
7 - Permitted use
7.1Equipment must be used only for professional film, television, broadcast, photography, or commercial production purposes within the United Kingdom.
7.2You may not sub-hire any item of equipment to any third party under any circumstances.
7.3Use of equipment outside the United Kingdom requires our prior written consent. Additional insurance requirements may apply.
8 - Cancellation
8.1Cancellations must be notified in writing to hello@evy.rentals.
8.2More than 7 days before the hire start date: full refund.
8.3Between 2 and 7 days before the hire start date: 50% refund.
8.4Within 48 hours of the hire start date: no refund. The hire fee is retained in full.
8.5Equipment may be rescheduled to alternative dates subject to availability, at our discretion.
8.6We reserve the right to cancel a booking at any time, including where we have reasonable grounds to believe the hirer does not hold adequate insurance or where the intended use falls outside clause 7. In the event of cancellation by us, a full refund will be issued.
9 - General
9.1These terms constitute the entire agreement between us in relation to the hire of equipment and supersede any previous representations or agreements.
9.2We reserve the right to update these terms. The version in force at the time of booking applies.
9.3These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10 - Your details
10.1When you send a quote request or enquiry, we collect what you put in the form: your name, email address, dates, location, the kit you're after and any notes. If you book, we also hold what we need to invoice you and confirm your insurance.
10.2We use those details to reply to you, arrange and invoice the hire, and sort out anything that comes up afterwards. That's all. You asked us for a quote or a hire, and we need your details to deal with it. No mailing lists, no marketing, and we don't sell or pass your details to anyone else for their own use.
10.3Form submissions are stored by Netlify, which hosts this site. Emails to hello@evy.rentals are forwarded by ImprovMX to our main inbox, which is run by Google. All three are US companies that handle the data on our behalf.
10.4Enquiries that don't turn into a booking are deleted within 12 months. Booking and invoice records are kept for six years, because HMRC requires it.
10.5This site doesn't use cookies or analytics, and doesn't track you.
10.6You can ask to see the details we hold about you, have them corrected, or have them deleted (unless we have to keep them for tax records). Email hello@evy.rentals. If you're unhappy with how we've handled your details, you can complain to the Information Commissioner's Office at ico.org.uk.
These terms have been drafted in good faith for a sole-trader hire operation and are provided as-is. They do not constitute legal advice. If you have questions about any clause, contact us before booking.
